Terms of use for the website, and the structure of the terms of sale applicable to the NavOps application.

Preamble

This document brings together two distinct sets of terms:

  • the terms of use for the www.navops.fr website, which apply as soon as you browse it;
  • the terms of sale for the NavOps application, which apply if you subscribe.

The site is an information medium. No subscription, no payment and no account creation happen on this site: those operations take place in the application, on a separate domain.

Website terms of use

1. Purpose

These terms of use set out the conditions for accessing and using the www.navops.fr website, whose purpose is to present the NavOps solution.

2. Access to the site

Access to the site is free and open. It requires no account and no registration. The publisher makes every effort to keep it available without being obliged to, and may interrupt access for maintenance without notice.

3. Site content

Published information, including functional descriptions and pricing elements, is provided for guidance and does not constitute a contractual offer. The amounts shown on the Pricing page may change until validated, and bind the publisher only once carried over into a signed contractual document.

4. Intellectual property

The site’s content is protected. Conditions of use are set out in the legal notice.

5. Personal data

The site collects no personal data and sets no cookies. See the privacy policy.

6. Changes to these terms

The publisher may amend these terms of use. The applicable version is the one published on the site at the time of browsing.

Application terms of sale

This part is a scaffold. It must be completed and reviewed by legal counsel before any commercial use.

7. Scope

These terms of sale govern the supply of the NavOps application by [legal name] to professional customers. They prevail over any document issued by the customer, unless otherwise agreed in writing.

8. Description of the service

The application is supplied in one of two deployment modes:

  • Sovereign cloud: a service hosted and operated by the publisher on infrastructure located in France.
  • On-Premise: a licence to use a standalone executable, installed and operated by the customer on its own infrastructure.

The functional scope subscribed is defined by the chosen offer and recorded in [the order form or the contract].

9. Subscription and term

  • Subscription route: [to be defined — online journey, signed order form, or both].
  • Initial term: [period].
  • Renewal: [automatic or express], with a notice period of [period].

10. Price and invoicing

  • Price basis: number of entities steered and modules switched on.
  • Invoicing frequency: [monthly, annual].

11. Customer obligations

The customer undertakes to:

  • appoint the administrators authorised to manage access;
  • enable multi-factor authentication and keep the account lifecycle up to date;
  • guarantee the lawfulness of the data it loads into the application;
  • in On-Premise mode, operate the service, run backups and apply the security versions made available.

12. Publisher obligations

The publisher undertakes to:

  • supply the service in line with the subscribed scope;
  • keep the application operational and publish security patches for both deployment modes;
  • in sovereign cloud mode, host the data in France and run backups;
  • not access the customer’s steering data outside the cases set out in the contract.

13. Service level

[Availability commitments, maintenance windows, incident response times and any penalties — to be defined. On-Premise mode carries no availability commitment, since operations are the customer’s responsibility.]

14. Data ownership and reversibility

The customer remains the owner of the data it loads into the application. It may export that data at any time in an open format, free of charge and without action from the publisher. At the end of the contract, the data is [return and deletion terms, and associated timeframes].

15. Confidentiality

Each party undertakes to preserve the confidentiality of the other’s information, for the term of the contract and [period] thereafter.

16. Liability

18. Personal data processing
